When you visit this website and/or use my services you agree that you are over the age of 18 and willing to be bound by these Terms and Conditions. If you don’t accept this agreement, you should not continue to visit this website.

These terms may be changed or modified periodically. Please check back regularly to ensure you are aware of any changes.

From time to time I may offer a service / workshop / course where there may be additional specific terms of service provided to you in relation to that service / training / course. If there is any inconsistency between this document and those specific terms of service, this document is overruled to the extent of the inconsistency.

There is no professional relationship formed by your visit to my website unless you explicitly choose to work with me by purchasing my services or products. 

Any testimonials or promised results I may display on this website are based on my experience and those of my previous clients. They are not guarantees that anyone else will achieve the same results.

Disclaimer for Services and/or Products

There are a number of ways you may choose to work with me that are available to purchase or book through my website. The terms and conditions in this document apply to all of my services and products unless alternative terms are explicitly stated. 

I offer comprehensive initial, follow-up and acute naturopathic consultations in clinic and online. My intention is to offer individualized care and treatment support; to supply the support, encouragement and education that will empower each client to take charge of their own health and wellbeing.

My Qualifications and Responsibility

I am a fully qualified Naturopath, trained to provide naturopathic, nutritional and herbal recommendations and products. I am a member of industry associations Naturopaths & Herbalists Association of Australia (NHAA) and Australian Traditional Medicine Society (ATMS). I keep my skills up to date with continuous professional development, researching the latest developments in my field, taking all reasonable care and due diligence, and committing to best practice. 

Your Responsibility

I will apply my skills and qualifications to give you the best possible naturopathic care. You must be open and honest in our dealings and provide accurate information and details about your diagnosed condition, your prescribed medications, over the counter pharmaceuticals or nutritional & herbal supplements that you are taking and known allergies or sensitivities so that informed recommendations can be made and potential interactions between medications can be avoided. You must inform me if there are any changes in your condition or with your medications or treatment, in order to assess contraindications or adverse interactions.

On purchasing any supplements from me or elsewhere, it is your responsibility to check that the products are suitable and safe for you in your current health condition. Take all supplements according to the label and dosage, unless prescribed otherwise in writing.  

Waiver of Liability

While I make all reasonable efforts to ensure that my services and/or products meet with the highest standards of best practice, if something does go wrong that isn’t a direct result of my negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law, I will not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to good will or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of my website, any products or services purchased through it, or any material posted on it, irrespective of whether such damages were foreseeable, or arise in contract, tort, equity, restitution, by statue, at common law or otherwise.

Security Policy

Payments made through this website are processed using Square. I do not have access to your account details. Any financial information you enter is stored under Square’s security policy: https://squareup.com/au/en/security

Payment Term

Payment is required on the day of booking, or on the day of service. If you are experiencing financial difficulties, it is important to discuss this prior to booking and/or attending the clinic. For payment on the day of service, I take payment on a Square EFT at the end of the consultation or I will send an invoice to you. This invoice is due within 7 days of the date on the invoice. On invoices more than 90 days overdue you agree to be responsible for costs, including debt collection agency fees and solicitor’s costs, whether or not legal proceedings are issued in relation to the debt.

Appointment Policies

Cancellation, Rescheduling and Lateness

I consider your time to be valuable. I consider my time to be valuable too. Cancellation of consultation requires 24 hours notice so that someone else may take that timeslot. 

If a cancellation is made less than 24 hours of the scheduled consultation, you will incur 100% of the total fee. Please contact me if you would like to discuss a cancellation that falls within 24 hours.

If unforeseen circumstances arise, and I am unable to proceed with the appointment, a full refund or rescheduling will be offered to you. 

Re-scheduling appointments also requires 24 hours notice. Re-scheduling appointments within 24 hours of the consultation will be based on my discretion and may incur 50% of the fee. 

If you are late for your consultation, please understand that I will not be able to extend your appointment beyond the designated end time. I understand that sometimes things happen that are beyond our control. Please get in touch to discuss your circumstances.

Refund Policy & Consumer Guarantees

I do not offer a refund after a completed consultation or if you change your mind. 

You can return and exchange supplements that you have purchased from me if you have changed your mind. The product is to be returned as new, unopened, undamaged and at your own cost. Please email your concern and your intention to claire@naturopathmargaretriver.com.au. Once the product/s have arrived back to me, I will process your refund or exchange. 
For faulty or recalled products, I will arrange return of products to me and to the supplier at my cost and I will refund you. 

It is important to use any supplement as directed on label, including dosage, as any misuse is potentially unsafe. 

Invitation to discuss a problem

If you feel that there is any problem with my service/s, please let me know within 24 hours. I am keen to understand what has gone wrong if you are unhappy so that I can address your concerns and try to find a mutually acceptable solution.

Limitation of liability

I take my obligations under Australian Consumer Law seriously and will do my best to address any issues that arise. However, even if there is a major problem, my liability is strictly limited to: 

  • Replacing the goods or supplying the services again or;

  • if I am unable to do so within a reasonable time, paying the cost of having the relevant goods or services supplied to you again.

Respectful Communication

Comments Policy

I reserve the right to delete any comments on my website or social media accounts which is rude, offensive or which I deem to be unacceptable. Keep it polite and play nicely, please! 

Dispute Resolution & Jurisdiction

If either of us have any concerns arising out of these terms, your use of my website or my provision of products or services, we agree that we shall communicate with the intention of making a genuine effort to seek a win/win solution and resolve any dispute by negotiation and discussion. Please email your concerns to claire@naturopathmargaretriver.com.au and you will have a response within four business days.

If we are unable to resolve a dispute by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking online dispute resolution or mediation by telephone if we are not both in Western Australia.

The mediator is to be appointed by agreement between us or, failing agreement within 21 days of the negotiation period ending, the person initiating the dispute will seek the appointment of a dispute resolution professional by the President of the Law Society of Western Australia or similar neutral authority. 

We agree to share all the costs of mediation equally between us.

We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.

Everyone involved in the dispute agrees that they will not publicly or privately disparage any other party or anyone associated with them, and will act in good faith to refrain from any conduct or communication which might reasonably be expected to interfere with any other party’s business or personal interests.

This agreement is subject to the governing law of Western Australia. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Western Australia and the Commonwealth of Australia, will have exclusive jurisdiction.
